ICC Updates Judicial Ethics Code With Social Media Rules and Binding Standards

The International Criminal Court has revised its judicial ethics code to address social media use and expressly recognize that its standards are binding.

The International Criminal Court’s revised Code of Judicial Ethics took effect October 16, introducing an explicit caution on judges’ use of social media and clarifying that violations of the code may amount to misconduct.

The amendments address articles 10 and 12 of the code. ICC judges agreed to the changes during their September 29 retreat, acting under regulation 126 of the Regulations of the Court.

Social Media Use Addressed

A new paragraph in article 10 states that judges must exercise caution when using social media and other information technologies.

The addition places digital communication explicitly within the Court’s ethical framework. According to the ICC’s announcement, the revisions are intended to keep that framework contemporary and consistent with the dignity and public trust attached to judicial office.

Ethical Standards Are Binding

The revised article 12 expressly recognizes that the ethical standards established by the code are binding. It also makes clear that noncompliance may amount to misconduct.

That wording distinguishes an ethical obligation from optional guidance. The announcement does not state that every breach automatically constitutes misconduct or prescribe a particular penalty for violations.

Changes Took Effect Upon Publication

Both amendments entered into force October 16, when the revised code was published on the ICC website.

The Court described the changes as part of its judiciary’s continuing effort to strengthen the standards governing judges’ conduct and reaffirm its commitment to the highest ethical standards.
