THE HAGUE — April 2, 2026 — The International Criminal Court is set to deliver a pivotal judgment on April 22, 2026, in the case of The Prosecutor v. Rodrigo Roa Duterte, marking a major development in one of the Court’s most closely watched proceedings.

Appeal Decision Set for April 22

The ICC’s Appeals Chamber will issue its ruling at 11:00 a.m. (The Hague time) in open court. The decision will address the Defence’s appeal challenging the Court’s jurisdiction in the case involving Rodrigo Duterte.

The ruling follows an earlier decision on October 23, 2025, when Pre-Trial Chamber I rejected the Defence’s jurisdictional challenge. Duterte’s legal team formally appealed that decision on October 28, 2025, submitting a detailed appeal brief on November 14, 2025.

Background of the Case

Duterte is accused of crimes against humanity, including murder and attempted murder, under Article 7(1)(a) of the ICC’s founding statute. Prosecutors allege these acts were committed as part of a widespread and systematic campaign during the Philippines’ controversial “war on drugs” between November 1, 2011, and March 16, 2019.

A warrant for Duterte’s arrest was initially issued under seal on March 7, 2025, before being made public days later. He was surrendered to the ICC on March 12, 2025, and made his initial court appearance on March 14, 2025. Most recently, the confirmation of charges hearing took place from February 23 to 27, 2026.

How to Watch and Attend

The hearing will be streamed live via the ICC’s official website, as well as its Facebook and YouTube channels.

Members of the diplomatic corps, civil society, and journalists can request access to attend the hearing in person at the ICC headquarters in The Hague. Requests must be submitted by April 15, 2026, and all attendees must present valid identification upon entry.

Due to limited seating in the public gallery, general public access will be granted on a first-come, first-served basis, with attendees encouraged to arrive at least one hour early.
